INDEMNITY AND CONTRACT AGREEMENT:

I {name} will not hold or attempt to hold Watershed Brazilian Jiu Jitsu LLC, Associated Instructors and/or Staff liable for any loss, damage, or injury to person or property caused by any act or neglect of other persons, or caused in any manner other than the willful or negligent act of Watershed Brazilian Jiu Jitsu LLC, Associated Instructors and Staff, its agents and employees, and will indemnify and hold Watershed Brazilian Jiu Jitsu LLC, Associated Instructors and Staff harmless from any liability for damages or claims against Watershed Brazilian Jiu Jitsu LLC, Associated Instructors and Staff arising out of or in any way related to any such loss, damage or injury. I release Watershed Brazilian Jiu Jitsu LLC, Associated Instructors and Staff, including its trustees, employees and agents, from me or my child’s physical injury, including death, or illness while at the activity. I/We will assume the risk associated therewith, whether known or unknown to me/us at this time. This release is also intended to include all claims of my family, estate, heirs, personal representatives or assigns.

INFECTIOUS DISEASE RISK ACKNOWLEDGEMENT AND AGREEMENT:

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.  I further acknowledge that Watershed Brazilian Jiu Jitsu LLC, has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.
I further acknowledge that Watershed Brazilian Jiu Jitsu LLC, cannot guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff and other members and their families/guest.

I voluntarily seek services provided by Watershed Brazilian Jiu Jitsu LLC, and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending classes.

I attest that:

• I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
• I have not traveled internationally within the last 14 days.
• I have not traveled to a highly impacted area within the United States of America in the last 14 days.
• I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
• I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by state or local public health authorities.
• I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
• I do not knowingly have any active contagious disease that may infect others to include but not limited to: the flu, common cold, contagious skin rash/infection, warts, herpes (cold sores), etc.
• I will wash or sanitize my hands before and after each class.
• I will have a clean body/uniform/gym attire for each class.
• I will honor all safety rules and etiquette of the academy.
• I will stay home if sick or have any known contagious condition until cleared by a medical doctor and/or fully recovered.
• I will report any illness to the staff of Watershed Brazilian Jiu Jitsu LLC, and agree to allow notification to other members that I may have come into contact with.
• I understand and assume all risks associated with Coronavirus/COVID-19.

I hereby release and agree to hold Watershed Brazilian Jiu Jitsu LLC, harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the academy/studio, or that may otherwise arise in any way in connection with any services received from Watershed Brazilian Jiu Jitsu LLC. I understand that this release discharges Watershed Brazilian Jiu Jitsu LLC from any liability or claim that I, my heirs, or any personal representatives may have against the academy/studio with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Watershed Brazilian Jiu Jitsu LLC. This liability waiver and release extends to the academy/studio together with all owners, partners, employees, and subcontractors.

AUTHORIZATION FOR TREATMENT:

I/We hereby give permission to the medical personnel selected by Watershed Brazilian Jiu Jitsu LLC to secure and administer treatment and to maintain and/or release any medical records necessary for insurance purposes as outlined under the HIPAA regulation, and to provide or arrange necessary related transportation for the above-named person. I verify that I or child named above is in good health and capable of participating in strenuous activities and, when necessary, will tailor my/their activities to those within the bounds of my/their physical health. I recognize that any medical treatment that is provided to me (or my child) while attending activities at Watershed Brazilian Jiu Jitsu activity will be paid for by my medical insurance company and guarantee payment for services not paid by insurance.

PHOTO AND VIDEO RELEASE:

I hereby grant Watershed Brazilian Jiu Jitsu LLC permission to use, reproduce, and/or distribute photographs, films, video and sound recordings of me or my child without compensation or approval, for use in materials created for purposes of promoting the activities of Watershed Brazilian Jiu Jitsu LLC and Associated Instructors and Staff, including the Internet.

AUTHORIZATION FOR EMAIL/PHONE COMMUNICATIONS:

I/We hereby give permission to Watershed Brazilian Jiu Jitsu LLC,  to contact me via email or phone. This may include but not limited to newsletters and text for special announcements.

NON-COMPETE / NON-SOLICIT COVENANT*:

1. Guest/Member agrees not to teach Watershed Brazilian Jiu-Jitsu Curriculum within a 50-mile radius of Watershed Brazilian Jiu Jitsu without written permission from Watershed Brazilian Jiu Jitsu LLC.
2. Guest/Member agrees he/she isn’t an active member, competitor, instructor, or owner of another local martial arts school.
3. Guest/Members agrees never to solicit active/former members of Watershed Brazilian Jiu Jitsu for a similar business or activity.   

*Covenant does not apply if guest/student/member receives written permission from Watershed Brazilian Jiu Jitsu LLC.

PROPERTY DAMAGE / CLASS OVERAGE(S)

Signee agrees to pay for any property damage they/the child they are responsible may cause while attending classes at the academy.  This includes intention or accidental damage that maybe cause by not following academy rules such as no metal/jewelry in training areas.  Signee also agrees to pay a $30.00 mat fee for any classes taken past agreed upon trial period.
